People increasingly use generative AI chatbots for health information and advice. In doing so, these systems are becoming “shadow health systems”: privately governed technologies that increasingly perform healthcare functions outside traditional healthcare systems. They can influence how people understand symptoms, make health decisions, and decide whether to seek professional care. Yet they often fall outside the rules that normally apply to healthcare technologies. This lecture asks how EU law should respond when AI systems increasingly perform healthcare functions without being regulated as healthcare.
