Panel Discussion: The Effects of Climate Change Litigations on Swiss Democracy

The KlimaSeniorinnen v. Switzerland judgment of the European Court of Human Rights has sparked debate on democracy, separation of powers, and the role of international courts. Our panel will explore how democracy is invoked against the ruling, whether the decision reflects judicial activism, what systemic reforms could support the implementation of international judgments, and how the case shapes the ECtHR’s legitimacy. The role of amicus curiae interventions will also be addressed.
